Undiscovered Creatives CIC ("UC", "we", "us" or "our") is a Community Interest Company focused on amplifying underrepresented talent and connecting creatives with opportunities.

Our website provides information about UC, our community, events, opportunities, resources and other activities.

 

As UC develops, the website may also provide access to memberships, digital resources, merchandise, applications, event bookings, donations and other services.

Some of these services may have additional terms that apply specifically to them. Where this is the case, we will make those terms available before you use or purchase the relevant service.

2. Using Our Website

You may use our website for lawful purposes and in accordance with these Terms & Conditions.

Unless we specifically agree otherwise in writing, you retain ownership of the intellectual property rights in your work.

Submitting your work to UC does not automatically transfer ownership or copyright to us.

Where we need permission to use your work, we will explain the relevant rights and permissions at the point of submission.

For example, a particular opportunity may require permission for UC to:

  • Display your work on our website

  • Share your work on social media

  • Include your work in promotional materials

  • Use your name, biography or creator profile

  • Feature your work in an event, exhibition or publication

 

The specific terms applying to a submission will take priority over these general Terms & Conditions where there is any conflict.

You are responsible for ensuring that anything you submit:

  • Does not unlawfully contain another person's personal information

8. Purchases, Payments and Merchandise

UC may offer merchandise and other products through the website.

Where you purchase a product, the relevant product description, price, delivery information and any applicable purchase terms will be provided before you place your order.

Payment may be processed by third-party payment providers.

We do not generally store your full payment card details ourselves.

Where applicable, our Shipping, Returns and Refund Policy will provide further information about delivery, returns and refunds.

Nothing in these Terms limits your statutory rights relating to faulty, misdescribed or otherwise non-conforming goods.

Where you purchase digital content, the applicable price, content and access arrangements will be explained before purchase.

You must not reproduce, resell, redistribute or commercially exploit UC digital resources unless we have expressly permitted you to do so.

Where digital content is supplied immediately after purchase, you may be asked to expressly acknowledge that you want the content to be supplied before the end of any applicable cancellation period and that this may affect your statutory cancellation rights.

We will provide the information required by applicable consumer law before supplying digital content.

10. Donations

UC may accept voluntary donations through the website.

Undiscovered Creatives CIC is a Community Interest Company and not a registered charity.

A donation to UC should not be represented as a charitable donation or as eligible for Gift Aid unless this is legally applicable.

Information about the purpose of a particular fundraising campaign or donation request will be provided on the relevant page.

11. Opportunities and Job Listings

  • An opportunity will lead to employment or engagement

  • A third-party organisation will accept an application

  • Information provided by a third party will remain unchanged

 

Where an opportunity is provided by another organisation, that organisation may be responsible for the application process and any resulting relationship.

 

You should review the relevant organisation's terms and privacy information before submitting information directly to them.

 

UC is not responsible for the actions, decisions or conduct of third-party organisations advertising opportunities through our platform, except where responsibility cannot lawfully be excluded.

  • Abuse

  • Fraudulent activity

  • Deliberate misuse of UC services

We may take reasonable action where behaviour breaches our guidelines or these Terms, including removing content, restricting access or ending participation in a UC activity.

15. Our Responsibility to You

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

 

This includes liability for:

  • Fraud or fraudulent misrepresentation

  • Your statutory consumer rights

  • Faulty or misdescribed goods

  • Any other liability that cannot legally be excluded or limited

 

Where legally permitted, UC will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.

 

Nothing in these Terms affects your legal rights as a consumer.
